Beginning January 1, 2023, an agent under an Illinois healthcare power of attorney can present an electronic copy of the power of attorney instead of being required to present a paper copy.

Updates to the Illinois Power of Attorney Act, effective at the beginning of 2023, modernize powers of attorney. Instead of being required to present a paper copy of the healthcare power of attorney, an agent can present an electronic copy of the healthcare power of attorney. Attending physicians and emergency medical personnel are required to acknowledge the electronic power of attorney.

This change will make an agent’s job easier. Instead of having to carry around a paper copy of the power of attorney, the agent only has to have a PDF or image of the power of attorney in order for the agent’s power to be recognized.
